# Privacy Policy
**Last updated: October 22, 2026**
Darwin Liu LLC, doing business as X Agency ("X Agency," "we," "us"), runs xagency.com. This policy explains what personal information we collect, how we use it, who receives it, and the choices you have. It covers our website, our forms and tools (including the Revenue Report quiz), our emails, and our sales calls. Work we do with client data under a client contract follows that contract instead.

## 1. Information we collect
### Information you give us
- Contact details: name, work email, phone number, company, and job title.
- Business details you enter in our forms and tools, such as revenue range, marketing budget, the channels you run, and your goals.
- Messages you send us, plus notes, recordings, and transcripts from calls you book with us. We tell you before we record a call.
- Your email preferences.
Please keep sensitive information, such as health details or bank account numbers, out of our forms.
### Information we collect automatically
When you visit our site, our tools and our partners' cookies, pixels, and scripts record:
- Device and browser data: IP address, browser type, operating system, device type, and language.
- Usage data: pages you view, links you click, time on page, the site that sent you, and how you move through our forms.
- Approximate location (city, region, country), based on your IP address. We do not collect precise GPS location.
- Cookie IDs and advertising identifiers, including the click ID attached to an ad you clicked.
### Information from other sources
We may receive business contact details (name, title, company, work email, LinkedIn profile) from business data providers, LinkedIn, and public websites. Our CRM may also add company details, such as industry, size, and location, to records we already hold.
## 2. How we use your information
- To answer your requests, send the reports and resources you ask for, and schedule calls.
- To run sales conversations and deliver the services you buy from us.
- To send marketing emails about our services, events, and content. Every marketing email includes an unsubscribe link.
- To measure and improve our website, content, and forms.
- To show you our ads on other sites and social platforms, and to measure how those ads perform.
- To protect our site and business from spam, fraud, and abuse.
- To meet our legal, tax, and accounting obligations.
We do not use your information to make automated decisions that carry legal or similarly significant effects for you.
## 3. Who receives your information
- **Service providers** that run parts of our business for us, under contracts that limit how they use your data: HubSpot (CRM, forms, email, meeting scheduling, website hosting), Google Workspace (email and documents), Slack (internal notifications), meeting recording tools, AI tools our team uses for drafting and analysis, and our accounting and payment tools.
- **Analytics and advertising partners**: Google (Analytics, Ads, and Tag Manager), Meta (Facebook and Instagram), LinkedIn, and Microsoft Advertising (Bing). These companies collect data through cookies and pixels on our site and may also use it for their own purposes under their own privacy policies.
- **Professional advisers**, such as lawyers and accountants.
- **Authorities**, when the law requires it or when we need to protect our rights.
- **A buyer or successor**, if we sell or merge all or part of our business.
We do not sell your personal information for money. Some US state laws treat letting advertising partners collect data through cookies and pixels as a "sale" or "sharing" for targeted advertising. Section 5 explains how to opt out.
## 4. Cookies and similar technologies

You can block or delete cookies in your browser settings, though some site features may stop working. You can also use the [Google Analytics opt-out add-on](https://tools.google.com/dlpage/gaoptout), your [Google ad settings](https://adssettings.google.com/), and the ad preferences inside your Meta and LinkedIn accounts.
## 5. Global Privacy Control and Do Not Track
We treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sale or sharing of your personal information for targeted advertising. When our site detects GPC, it does not load our advertising pixels for that browser. Firefox, Brave, and DuckDuckGo support GPC, and extensions add it to other browsers.
Do Not Track has no common standard, so we do not respond to it. We honor GPC instead.
## 6. How long we keep your information
We keep contact and sales records while we have an active relationship with you and for up to 3 years after our last interaction. We keep billing records for 7 years for tax purposes. Our analytics and advertising partners keep cookie data under their own retention settings. When we no longer need your information, we delete or anonymize it.
## 7. Your US state privacy rights
Depending on your state of residence, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, you may have the right to:
- Know what personal information we hold about you, and get a copy.
- Correct inaccurate information.
- Delete your information.
- Opt out of targeted advertising and the sale or sharing of your information.
- Get a list of the categories of third parties that receive your information, or the specific third parties where your state allows it.
- Use these rights without paying more or getting worse service.
**How to make a request.** Email [hello@xagency.com](mailto:hello@xagency.com) with "Privacy request" in the subject line and tell us which right you want to use. To protect your data, we confirm that you control the email address on file and may ask for one more detail to verify you. You can name an authorized agent to act for you with your signed permission. We respond within 45 days and will tell you if we need up to 45 more.
**Appeals.** If we deny your request, reply to our decision with "Appeal" in the subject line. We answer appeals within 60 days. If we deny your appeal, you can contact your state attorney general.

We do not collect sensitive personal information, biometric data, or education records. Section 1 lists our sources, Section 2 our purposes, and Section 6 how long we keep each type of record. We do not knowingly sell or share the personal information of anyone under 16.
Under California's "Shine the Light" law, California residents can ask us once a year which third parties received their personal information for those third parties' own direct marketing. We do not disclose personal information for that purpose.
## 8. Visitors outside the US
We run our business from the United States and store your information there. If you are in the European Economic Area, the UK, or Switzerland, we rely on your consent for cookies that are not necessary, on our legitimate interest to answer business inquiries and market to businesses, and on contract to deliver services you buy. You can ask to access, correct, delete, restrict, or move your data, object to our use of it, or withdraw consent. You can also complain to your local data protection authority.
## 9. Children
Our site serves businesses. We do not knowingly collect information from anyone under 18. If you think a child sent us information, email [hello@xagency.com](mailto:hello@xagency.com) and we will delete it.
## 10. Security
We limit access to your information to staff who need it, and our site runs on HTTPS. No system is perfectly secure, so we cannot guarantee that unauthorized parties will never access your information.
## 11. Changes to this policy
When we change this policy, we update the date at the top. For material changes, we post a notice on our site or email you.
